Negotiate settlement agreement: what is fixed in a redundancy package and what moves

Negotiation works better when both sides know which numbers are actually in play. In a settlement offer most of the total is not: the statutory redundancy payment, accrued holiday and the notice entitlement are set by the Act and the contract, and arguing about them is arguing about arithmetic. The negotiable part is the compensation above those, and it moves for reasons that have little to do with your salary.

How to negotiate a settlement agreement: separate the fixed from the negotiable first

Statutory redundancy pay is computed under section 162 of the Employment Rights Act 1996 from your age bands, service capped at 20 years and a week's pay capped at 751 pounds for a redundancy on or after 6 April 2026, with a statutory maximum of 22,530 pounds. Statutory notice comes from section 86, or the contract where it is longer. Holiday accrued is a computation. Put those three on paper, subtract them from the offer, and what is left is the entire negotiation.

What actually moves settlement agreement negotiations

Four things, none of them your length of service, which has already been counted. The strength of the claim being waived, since the employer is buying the removal of a risk and prices it accordingly. The cost of the alternative, which is a defended tribunal claim in management time and fees. Timing, because an employer running a programme to a deadline values speed. And the non-cash terms: an agreed reference, the wording of the announcement, and the length of any restrictive covenant are frequently worth more than the last few thousand pounds and are easier for an employer to concede.

Can you negotiate redundancy pay?

The statutory element, no: it is an entitlement fixed by the formula and an employer cannot pay less, so there is nothing to negotiate. What is negotiable is any enhancement above it, how the notice is treated, and the ex gratia sum. In a voluntary round the enhancement is usually a published formula applied to everyone, which means the individual negotiation moves to the edges of it: an earlier or later leaving date, outplacement, keeping a company device, or the reference wording.

Where the tax line of a redundancy package is worth more than the headline

How the offer is apportioned changes what you actually receive. The sum attributable to notice is taxed as earnings whatever it is called, while other termination money falls under the section 403 threshold. Moving a line from one column to the other, where the facts genuinely support it, can be worth more than an increase in the headline figure and costs the employer nothing. It is also the part of the document an independent adviser is reading anyway.

Questions people ask about negotiate settlement agreement

How do I negotiate a settlement agreement?

Compute the fixed parts first, so you and the employer are discussing the same residual number, then argue that residual on the strength of the claim being waived and the cost of the alternative. Put the non-cash terms on the table at the same time, because they are often cheaper for the employer to give.

What is fixed when negotiating redundancy pay?

Not the statutory element, which is fixed by the formula in section 162. Any enhancement, the treatment of notice and the ex gratia compensation are all negotiable.

Is it worth asking for more when negotiating a settlement agreement?

This site cannot answer that for your situation and does not try. What it can say is which parts of the offer are fixed by statute, so that the question you put to your adviser is about the part that can actually change.
